The Real Estate (Regulation and Development) Act, 2016 — commonly known as RERA — was a landmark reform aimed at bringing transparency and accountability to India's real estate sector. If you're planning to buy a home, understanding RERA can protect you from delays, fraud, and misleading promises.

What Is RERA?

RERA mandates that every real estate project with more than 500 square meters of land or more than 8 units must be registered with the state's Real Estate Regulatory Authority before it can be advertised, marketed, or sold. Each state has its own RERA authority and website where buyers can verify project details.

Why RERA Registration Matters

Before RERA, homebuyers had little recourse against delayed possession, changed floor plans, or diverted funds. RERA changed that by requiring developers to:

  • Disclose the project's land title, approvals, and layout plans publicly
  • Deposit 70% of funds collected from buyers into a separate escrow account, used only for that project's construction and land costs
  • Provide accurate carpet area measurements instead of ambiguous super built-up figures
  • Complete the project within the timeline declared at registration, or pay compensation for delays

How to Verify a Project's RERA Status

Every state RERA website allows you to search by project name, registration number, or developer name. The registration certificate discloses the promoter's details, project completion date, sanctioned plans, and any litigation history. Never rely solely on a builder's marketing brochure — always cross-check with the official RERA portal before booking.

What RERA Means for Buyers

If a builder delays possession beyond the committed date, RERA entitles you to either a full refund with interest or monthly compensation until possession is handed over. Builders are also barred from making changes to the sanctioned plan without two-thirds consent from existing buyers, protecting you from unexpected alterations to your unit or the overall project layout.

Filing a Complaint Under RERA

If you face issues like delayed possession, false advertising, or quality deviations, you can file a complaint directly with your state's RERA authority, often through a straightforward online process with a nominal filing fee. RERA tribunals are designed to resolve disputes faster than traditional consumer courts.

Limitations to Keep in Mind

RERA doesn't apply retroactively to fully completed projects, and enforcement quality varies from state to state. Some smaller developers may also under-report project details, so due diligence is still essential even for RERA-registered projects.

Final Thoughts

RERA has significantly improved transparency in Indian real estate, but it works best when buyers actively use the tools it provides. Always verify RERA registration, read the disclosed documents carefully, and don't hesitate to raise concerns with the authority if something doesn't match what was promised. An informed buyer is a protected buyer.
